Gambling age by state
The legal gambling age depends on the game and the state. For commercial casinos, the minimum age is 21 in all 23 states with a recorded age. For sports betting, the minimum age is 21 in 34 of the 40 states with a recorded age; 18 in DC, Montana, New Hampshire, Washington and Wyoming and 19 in North Dakota. For the lottery, the minimum age is 18 in 41 of the 46 states with a recorded age; 21 in Arizona, Iowa, Louisiana and Mississippi and 19 in Nebraska.

| Kentucky | Not legal | 21iOriginally set at 18 by 2023's HB 551 (a floor amendment to raise it to 21 was defeated in the House on 3/13/2023). HB 904 (2026 Ky. Acts ch. 184, enacted via veto override effective 4/14/2026) raised the minimum sports-wagering age from 18 to 21. | 18 | Not legal | Not legal | — | 18iHB 904 (2026) sets the minimum age to play a fantasy contest at 18. The companion revenue bill, HB 757 (2026), separately defines a tax-paying "fantasy contest participant" as 21 or older for purposes of its fantasy-contest excise tax, so a provider's tax obligations turn on a higher age than the age set for play itself.?The two 2026 bills use different ages for different purposes; this fact reflects the licensing law's play-eligibility age, not the tax law's participant definition. | 18iPersons under 18 may not purchase charity game tickets or (with limited noncash-prize/parental-accompaniment exceptions) play bingo. |
| Louisiana | 21i"Each licensee and casino operator shall implement methods to prevent minors from entering the designated gaming area"; the Louisiana Administrative Code bars anyone under 21 from casino gaming areas. | 21iSports wagering operates under the same casino-licensee framework and age floor as other casino gaming.?No sports-wagering-specific statutory age provision was found separately from the casino age rule. | 21iThe Louisiana Lottery's own website footer states: "Must Be At Least 21 To Purchase." | — | Not legal | — | 21iFantasy-contest operators must verify that a player is at least 21 and hold contests only where the player is at least 21.?Based on the 2019 enrolled bill text, not the current codified statute. | — |

| Maryland | — | 21 | 18iMd. Code, State Gov't § 9-124(b)(4) bars selling "a State lottery ticket or share to a minor," and Maryland's general age of majority is 18. The Lottery's own public guidance confirms the purchase age directly, distinct from the 21+ minimum for casinos and sports wagering. | Not legal | Not legal | — | — | — |
| Massachusetts | 21 | 21iThe age-21 wagering requirement is set by the Gaming Commission's regulation 205 CMR 250.01, which requires operators to prevent "Persons younger than 21 years old" from wagering. | 18iG.L. c.10 §24 itself sets no retail-purchase age floor (it sets 18 as the minimum age to be licensed as a sales agent, and 21 for any future online/mobile lottery age verification); the 18-year purchase threshold is confirmed by the Lottery Commission's own regulation 961 CMR 2.50, which penalizes sales agents for selling tickets "to individuals younger than 18 years old." | — | Not legal | — | 21iDFS operators generally restrict play to ages 21 and up, consistent with the sports-wagering age floor.?Based on operator practice rather than a direct reading of 940 CMR 34.00, the Attorney General's governing regulation. | 18 |

[p]lay, be allowed to play, place wagers, or collect winnings, whether personally or through an agent, from any gaming authorized under this chapter." Mississippi Gaming Commission rule 13-2-2-8 similarly will not ordinarily license anyone under 21. | 21iSame 21-and-over requirement applies to sports wagering as a form of gaming "authorized under this chapter" per Miss. Code Ann. § 75-76-155(1)(a) (Title 75, Chapter 76 covers sports wagering as well as casino gaming); a narrower 2026 bill (HB 4074) that would have added an explicit under-21 online sports-wagering ban died in committee 2026-03-17, implying the general casino-age statute is relied on for sports wagering today rather than a sports-specific provision. | 21iConfirmed via the Attorney General's lottery-courier opinion, which states lottery retailers "are prohibited from selling lottery tickets to anyone under age 21" per Miss. Code Ann. § 27-115-73. | 21iSection 7.2 of the Tribal-State Gaming Compact between the Mississippi Band of Choctaw Indians and the State of Mississippi: "No person below the age of 21 on the date of Gaming shall be permitted to play any Class III Game." | Not legal | — | 18iMiss. Code Ann. § 97-33-305(2)(d) requires a fantasy-contest operator to "[v]erify that a fantasy contest player is eighteen (18) years of age or older" before accepting entry fees.?A separate provision (§ 97-33-307(5)) requires 21-or-older verification for fantasy contests offered on-premises at a licensed casino, so the minimum age is higher for that channel. | 18iMiss. Code Ann. § 97-33-67(5): "No licensee shall allow any person under eighteen (18) years of age to play a bingo game unless accompanied by his or her parent or legal guardian," and no one under 18 may assist in holding, operating or conducting the game.?The minimum age for pull-tab or raffle play specifically (as opposed to bingo) was not separately confirmed. |
| Missouri | 21 | 21 | 18 | Not legal | Not legal | 18iA race track licensee may not admit anyone under 18 to the wagering area during a race meeting or let them wager, except that a minor may be present if accompanied by a parent or guardian. | 18 | 16iMissouri's bingo law bars anyone under 16 from playing or helping conduct bingo; a person under 16 may be in the playing area only with a parent or guardian.?This age comes from the bingo-specific statute; a separate minimum age for pull-tabs or raffles under the same charitable-gaming license is not confirmed here. |
| Montana | Not legal | 18iSame statute as the lottery age floor, since Sports Bet Montana is a Montana Lottery product under Title 23, ch. 7; the operator's own site also states the 18-and-over requirement. | 18iMont. Code Ann. § 23-7-302(2): "Tickets, chances, wagers, or bets may not be sold to or purchased by persons under 18 years of age." This covers both lottery tickets and Sports Bet Montana wagers, since both are lottery products under Title 23, ch. 7. | — | Not legal | 18iA "minor" (under 18) may not use the parimutuel wagering system. | Not legal | 18?A narrow exception lets minors sell or buy raffle tickets, or receive raffle prizes, when the raffle's net proceeds go to charity, scholarships, or community-service projects. |

Raised to 21 by 1983 c.134. | 21iSame Casino Control Act framework (N.J.S.A. 5:12-119, tied to the alcohol-purchase age) governs sports wagering age at licensed venues/platforms. | 18 | Not legal | 21iSame N.J.S.A. 5:12-119 alcohol-age cross-reference applies to internet gaming accounts. | 18 | 18?This general DFS age floor is sourced to a secondary summary rather than DGE regulation text directly. | 18iAmusement-type games allow under-18 play for non-cash prizes.?The bingo/raffle age is sourced to a general secondary summary rather than the Bingo or Raffles Licensing Law text directly. |
| New Mexico | 21iSecondary-source casino directory states "Minimum age for casinos is 21 years old." | 21iSecondary-source casino directory separately lists 21 as the minimum gambling age for sports betting, consistent with the casino-floor age at the tribal casinos where sportsbooks operate. | 18i6-24-32(A) NMSA 1978 makes it unlawful to sell a lottery ticket to a person "under eighteen years of age." | 21iSame secondary source applies the 21 minimum to New Mexico casinos generally, without distinguishing tribal from racino. | Not legal | 18iSecondary source states pari-mutuel/bingo wagering is "open to 18-year-olds." | — | 18 |
