Kansas
- Kansas uses a state-owned destination casino model, with the Kansas Lottery owning four regional casinos run by contracted managers.
- Retail and online sports betting is tied to those four casinos, and online casinos and online poker are not authorized.
More detail
- Casinos. Kansas uses a unique state-owned "destination casino" model under the Kansas Expanded Lottery Act (KELA, enacted 2007). The Kansas Lottery legally owns and operates four regional casinos, one per gaming zone, through contracted "lottery gaming facility managers." They are Boot Hill Casino, Kansas Star Casino, Hollywood Casino at Kansas Speedway, and Kansas Crossing Casino. The state is statutorily entitled to at least 22% of facility revenue.
- Sports betting. Retail and online sports wagering was legalized in 2022 and launched in September 2022. It is tied to the same four facility managers and taxed at 10% of sports-wagering revenue.
- Racing. Historical horse race (HHR) machines are separately authorized under the Kansas Parimutuel Racing Act, but only at a single Sedgwick County facility (Gilley's, in Park City). They are taxed at 3% of handle.
- Online casinos. Online casino gaming (igaming) and online poker are not authorized.

| Commercial casinos | Live | Dec 1, 2009 | Monopoly State | Four state-owned "lottery gaming facilities" (one per gaming zone, capped by statute until July 1, 2032): Boot Hill Casino (Dodge City), Kansas Star Casino (Mulvane), Hollywood Casino at Kansas Speedway (Kansas City), and Kansas Crossing Casino and Hotel (Pittsburg). Facilities are managed under contract by private operators but legally owned/operated by the Kansas Lottery. K.S.A. 74-8701 et seq. (Kansas Expanded Lottery Act) [1],[2] |
| Tribal casinos | Live | Monopoly Tribal | Five Class III tribal-state gaming compacts/operations: Prairie Band Potawatomi Nation (Mayetta; opened a retail sportsbook in early 2024, with its compact reportedly being amended to add sports wagering under a 2025 legislative resolution); Kickapoo Tribe of Kansas (Golden Eagle Casino, Horton); Sac and Fox Nation of Missouri in Kansas and Nebraska (unnamed casino); Iowa Tribe of Kansas and Nebraska (unnamed casino); and Wyandotte Nation (7th Street Casino, Kansas City, plus a second facility, Crosswinds Casino, near Park City, under a new compact signed around March 2026 and deemed approved by operation of law when the U.S. Interior Department's 45-day review period lapsed, with Federal Register publication reported July 14, 2026; this compact reportedly includes a "hub-and-spoke" sports-wagering model). The legal basis for Wyandotte's off-reservation facility traces to a May 2025 Kansas AG Opinion (2025-11). Tribal compacts are negotiated by the Kansas AG/Governor under IGRA, not administered by KRGC, so KRGC's own pages do not cover them.[3],[4]? | |
| Lottery | Live | 1987 | Monopoly State | Kansas Constitution was amended in 1986 to authorize a state-owned and -operated lottery; the Legislature then enacted the Kansas Lottery Act in 1987, and ticket sales began in 1987 in 21 cities. Kansas is an original participant (since June 2002, alongside Nebraska) in 2by2, a MUSL regional daily-draw game also offered by Nebraska, North Dakota, and Wyoming. K.S.A. 74-8701 et seq. (Kansas Lottery Act) [5],[6],[7]? |
| iLottery | Live | Monopoly State | Kansas Lottery sells draw-game entries and digital eInstant games directly online/via app (PlayOn Kansas platform) alongside retail sales.[8]? | |
| Daily fantasy | Live | Competitive | K.S.A. 21-6403 excludes a qualifying "fantasy sports league" from the definition of "bet" in Kansas's criminal gambling statutes, treating DFS as a game of skill outside the KELA licensing framework; no dedicated DFS license or tax applies. The exclusion requires that no team be based on an actual team's current roster, that prizes be fixed in advance and not depend on the number of entrants or fees paid, and that outcomes reflect participants' relative knowledge and skill rather than the score or a single athlete's performance in one real-world event.[9] | |
| VGTs / VLTs | Not authorized | Kansas confines electronic gaming machines to the 4 KELA lottery gaming facilities and licensed racetrack facilities; no standalone bar/truck-stop VGT program identified.[1] | ||
| Historical horse racing | Limited | Monopoly State | Parimutuel wagering on historical horse races is authorized by statute only at a single organization-licensee facility located in Sedgwick County (Gilley's, Park City), through commission-approved "historical horse race machines." No random-number generator may be used; results must derive from actual historical races. K.S.A. 74-8801 (definitions); K.S.A. 74-8823(a)(5) [10] | |
| Sweepstakes casinos | Not authorized | Kansas has no statute or KRGC rule specifically authorizing or licensing sweepstakes-casino (dual-currency) platforms, so the activity is not authorized, notwithstanding that sweeps operators appear to continue serving Kansas customers without enforcement. Multiple industry-tracker roundups of the 2026 state sweepstakes-ban wave list California, Indiana, Maine, New York, Louisiana, and Tennessee as having acted, but do not list Kansas.[11],[12]? | ||
| Prediction markets | Not authorized | No Kansas statute authorizes prediction-market event contracts, so the activity is not authorized, notwithstanding that platforms remain accessible to Kansas customers. The Kansas Racing and Gaming Commission has taken no enforcement action: KRGC enforcement attorney James Bain told Sports Betting Dime (reported June 16, 2026) the commission is "not planning on sending cease-and-desist letters to prediction market platforms" at this time and is instead watching the outcome of the Kalshi litigation in Nevada and New Jersey before deciding. No Kansas AG opinion or court filing addresses the issue. Kansas sits in the 10th Circuit, which has not ruled on CEA preemption of state gambling/sports-wagering law; compare the 3rd Circuit (NJ, April 6, 2026, for Kalshi), 6th Circuit (OH/TN, September 25, 2026, against Kalshi), and 9th Circuit (NV, August 28, 2026, against Kalshi).[3],[13] | ||
| Skill games | Contested | Legal status of unregulated skill/slot-like terminals is unsettled. In Dec. 2024 the Kansas Supreme Court held that POM of Kansas (a subsidiary of manufacturer Pace-O-Matic) lacked standing to sue state regulators over the "Dragon's Ascent" arcade game, because no cease-and-desist order had been issued and neither KRGC nor the Attorney General had opined the game was illegal; the court did not decide whether the game is skill- or chance-based. Kansas has no statutory process for certifying a game as skill-based rather than chance-based, leaving the devices in a legal gray area. No 2025-2026 legislative or enforcement update was found.[14] | ||
| Card rooms | Not authorized | KRGC public guidance states that betting/wagering-based fundraising activities (including poker games) are illegal in Kansas outside the licensed KELA/parimutuel/lottery framework.[15] | ||
| Lottery couriers | Not authorized | K.S.A. 74-8718(a)(2) makes it unlawful "for any person other than the Kansas lottery or a lottery retailer authorized by the Kansas lottery" to "sell or resell any lottery ticket or share," and 74-8718(a)(4) separately bars retail ticket sales "by electronic mail, the internet or telephone." Neither provision carves out a third-party courier model. Consistent with this, as of October 2026 neither Jackpocket nor Lotto.com -- the two national courier operators -- lists Kansas among its operating states, and Kansas has issued no courier-specific cease-and-desist, lawsuit, or public statement, unlike Washington, where an actual enforcement action exists; the activity is accordingly unaddressed rather than affirmatively banned.[16],[8] | ||
| Pick'em fantasy | Not authorized | KRGC Executive Director Don Brownlee determined roughly ten operators were running illegal sports betting under a fantasy label, and KRGC sent cease-and-desist letters (beginning 2023-09-07) to at least six, treating player-vs-house pick'em/player-prop contests as unlicensed sports wagering rather than fantasy sports. Underdog (the only operator to confirm receiving a letter) pulled its pick'em product from Kansas, then returned in September 2024 under a peer-to-peer "Champions" format that KRGC's director of security said "complies with the spirit of Kansas law." Traditional house-vs-player pick'em thus remains unauthorized; reformatted peer-to-peer contests are treated as ordinary DFS.[17],[18] | ||
| Pari-mutuel | Live | Competitive | Licensed organization licensees may conduct live horse/greyhound racing with parimutuel wagering; takeout capped at 18% of each pool (25% for multiple/exotic bets). Eureka Downs racetrack licensing office reopening in fall 2026 per KRGC site. K.S.A. 74-8801 et seq. (Kansas Parimutuel Racing Act); K.S.A. 74-8823 [10] | |
| Advance deposit wagering | Not authorized | The Kansas Parimutuel Racing Act defines and licenses live racing, simulcasting, intertrack wagering, and "off-track wagering" (wagering on a simulcast race at a licensed off-track facility), but contains no definition of, or licensing framework for, "advance deposit wagering" or "account wagering." K.S.A. 74-8843(f) separately and explicitly bars wagering on historical horse races "over the internet or a digital cellular network, including through any website or mobile device application," underscoring that the Act treats internet/mobile wagering as a distinct, unaddressed category rather than folding it into licensed ADW. No KRGC rule, license list, or regulation creates an ADW provider category. National ADW platforms nonetheless accept Kansas residents in practice: Action Network's state tracker lists TwinSpires, DRF, and AmWager as available to Kansas bettors (FanDuel Racing, TVG, and DraftKings Horse as not), consistent with access under the federal Interstate Horseracing Act rather than any Kansas-specific state authorization.[10],[19],[20] | ||
| Charitable gaming | Limited | Nonprofit religious, charitable, fraternal, educational and veterans' organizations may run call bingo, instant bingo and raffles under the Kansas Charitable Gaming Act (K.S.A. 75-5171 et seq.), which the Department of Revenue licenses and taxes. The act replaced the Kansas Bingo Act (K.S.A. 79-4701 et seq.) on July 1, 2015. Other wagering fundraisers, such as poker games, remain illegal.[21],[22],[23],[15] | ||
| Esports betting | Not authorized | KRGC's sports-wagering regulations (1 K.A.R. 112-201-1 et seq., permanently adopted 2026 per 2026 Senate Sub. for SB 356) define "sports event" and "sports wagering" without reference to esports in the portions located; a 2020 legislative description of the sports-wagering bill defines a sports event as excluding horse/greyhound races under the Parimutuel Racing Act and events where a majority of participants are minors, again without addressing esports. No KRGC guidance, license, or enforcement action on esports wagering specifically was found.[24],[25] | ||
| Social casino | Live | No Kansas statute or KRGC action addresses free-to-play, no-cash-prize social casino apps. Kansas has likewise not enacted anything reaching pure social casino play when it looked at sweepstakes-style dual-currency products, since play with no real money at stake falls outside Kansas's gambling definition, which requires a thing of value staked for gain.[2] |

- Where gaming tax revenue goes (education fund
- KELA lottery-gaming-facility revenue (at least 22% of gross) and sports-wagering revenue (10% of gross) both end up in state funds that are appropriated rather than spent directly. Facility revenue is credited to the Expanded Lottery Act Revenues Fund (K.S.A. 74-8768): after a fixed $10,500,000 a year split three ways among the Kan-Grow engineering funds at KU, KSU, and WSU, half of what remains goes to the Kansas Public Employees Retirement System to reduce its unfunded liability, with the balance available by appropriation for state debt reduction, infrastructure, and local property-tax relief. Sports-wagering revenue is instead credited to the Sports Wagering Receipts Fund (K.S.A. 74-8791) and transferred into the lottery operating fund (K.S.A. 74-8711) -- the same fund that receives ordinary lottery ticket proceeds and earmarks money to the state general fund, problem-gambling programs, crisis-stabilization and clubhouse mental-health programs, white-collar-crime enforcement, attracting professional sports to Kansas, and county property reappraisal. Separately, 2% of lottery-gaming-facility revenue funds the Problem Gambling and Addictions Grant Fund and 1.5-3% goes to the host city/county. Racetrack electronic-gaming-machine income is split differently: 40% to the Expanded Lottery Act Revenues Fund, 25% to the facility manager, 7%+7% to horse/greyhound purse supplement funds, 2% to the problem gambling fund, 1% to the Kansas horse fair racing benefit fund, and 15% to gaming expenses. Parimutuel/HHR taxes go to the State Racing Fund (K.S.A. 74-8826).[1],[10],[27]

- All lottery ticket/share sale proceeds go to the lottery operating fund; by statute at least 30% of monthly lottery ticket/share revenues (20% for pull-tabs), or the fund's excess balance if greater, is transferred monthly to the State Gaming Revenues Fund, with further earmarked transfers to the state general fund, the problem gambling and addictions grant fund, the community crisis stabilization centers fund, the clubhouse model program fund, the white collar crime fund, the attracting professional sports to Kansas fund, and the county reappraisal fund (K.S.A. 74-8711).[27]

Notes
K.S.A. Consistent with this, as of October 2026 neither Jackpocket nor Lotto.com -- the two national courier operators -- lists Kansas among its operating states, and Kansas has issued no courier-specific cease-and-desist, lawsuit, or public statement, unlike Washington, where an actual enforcement action exists; the activity is accordingly unaddressed rather than affirmatively banned.
