Oklahoma
- Legal gambling in Oklahoma is almost entirely tribal, with 35 tribes running roughly 130 or more casinos under the 2004 State-Tribal Gaming Act.
- Two non-tribal racetrack racinos also operate, but sports betting, online casinos and online poker are not legal.
- Sports betting has repeatedly failed in the Legislature amid a standoff between the governor, lawmakers and the tribes.
More detail
- Tribal gaming. The legal market is built almost entirely around 35 tribes operating under the 2004 State-Tribal Gaming Act and Model Tribal Gaming Compact. It covers Class III electronic games and non-house-banked card games at roughly 130+ tribal casinos. The compacts were automatically renewed in 2020 after litigation and contain no sports-wagering authorization.
- Racinos. Two non-tribal racetrack racinos, Remington Park and Will Rogers Downs, are authorized to run the same electronic amusement games. They operate under the same 2004 ballot measure (SQ 712).
- Casinos. There is no legal commercial casino gaming outside the tribal and racetrack framework.
- Sports betting. There is no legal sports betting of any kind. It has repeatedly failed in the Legislature (2023-2025) amid a three-way standoff between Gov. Kevin Stitt, the Legislature, and the Oklahoma Indian Gaming Association.
- Online casinos. There is no igaming or online poker.

Legal status
| Vertical | Status | Launched | Model | Details |
|---|---|---|---|---|
| Sports (online) | Not authorized | Same as sports_retail; no mobile/online sports wagering statute exists. Gov. Stitt has proposed statewide mobile licensing (2023 plan, SB 1434 2024) but nothing has passed.[1],[2] | ||
| Sports (retail) | Not authorized | No statute authorizes retail sports wagering. The Model Tribal Gaming Compact's "covered games" list (Title 3A § 281, Part 3) does not include sports wagering, and multiple bills to add it (HB 1027 in 2023, SB 1434 in 2024, HB 1047/HB 1101/SB 585 in 2025) did not clear the Legislature.[1],[2],[3] | ||
| Online casino | Not authorized | No statute or compact provision authorizes online casino games.[1] | ||
| Online poker | Not authorized | No statute authorizes online poker; non-house-banked card games under the compact are land-based only.[1] | ||
| Commercial casinos | Limited | Hybrid | No freestanding commercial casinos. Two racetrack "organization licensees" (Remington Park in Oklahoma City, Will Rogers Downs in Claremore) are authorized under Title 3A §§ 268-282 (enacted via State Question 712, Nov. 2, 2004) to operate the same category of electronic amusement games/electronic bingo as tribal casinos, tied to their racing licenses; they do not offer table games. 3A O.S. §§ 268-282 [4],[1] | |
| Tribal casinos | Live | Jan 1, 2005 | Monopoly Tribal | 35 tribes hold Class III compacts (identical Model Tribal Gaming Compact adopted via SQ 712 in 2004) covering electronic amusement games, electronic bonanza-style/instant bingo, and non-house-banked card games at 130+ facilities statewide. Compacts had an initial term to Jan. 1, 2020 and renew automatically for successive 15-year terms absent a change in the state's authorization of non-racing electronic gaming; a 2020 federal court ruling confirmed automatic renewal through 2035 over Gov. Stitt's objection. 3A O.S. §§ 261-282; Model Tribal Gaming Compact, 3A O.S. § 281 [1],[5],[6] |
| Lottery | Live | Oct 12, 2005 | Monopoly State | Approved by voters in Nov. 2004 (SQ 705 created the Lottery Commission; SQ 706 created the Lottery Trust Fund for education); ticket sales began Oct. 12, 2005. Oklahoma Education Lottery Act; SQ 705, SQ 706 (2004) [7],[8] |
| iLottery | Not authorized | The Oklahoma Lottery does not sell draw tickets or e-instants directly online. A June 2025 report said the Lottery was exploring a "digital platform," possibly as a competitive response to third-party couriers, plus an app upgrade letting winners claim prizes digitally, but neither confirms live online ticket or e-instant sales.[8],[9],[10] | ||
| Daily fantasy | Not authorized | No Oklahoma DFS statute has ever been enacted. House Bill 2278 (2016), which would have created an "Oklahoma Fantasy Contests Act" to license and regulate DFS operators, stalled in the Legislature after tribal gaming interests (including the Cherokee Nation) opposed it; sponsor Sen. David Holt dropped the bill. DraftKings- and FanDuel-style contests are commonly reported to continue operating in the state without explicit statutory authorization or prohibition.[11] | ||
| VGTs / VLTs | Not authorized | No freestanding VGT/VLT program outside the tribal-compact and racetrack "electronic amusement games" framework exists.[4] | ||
| Historical horse racing | Not authorized | Oklahoma's racetrack electronic devices are "electronic amusement games" under Title 3A, not historical-horse-racing (HHR) terminals as defined/marketed in states like Kentucky/Wyoming; no HHR-specific authorization was found.[4] | ||
| Sweepstakes casinos | Not authorized | Senate Bill 1589 bans online sweepstakes casino games that use dual-currency models to risk "representatives of value," extending liability beyond operators to any "geolocation provider, gaming supplier, platform provider, promoter, or media affiliate." Gov. Kevin Stitt vetoed the bill on May 7, 2026, calling it "vague and overbroad" and saying it "creates uncertainty for businesses operating in good faith," but the Legislature overrode the veto on May 14-15, 2026 (House 68-19, Senate 34-10). Violations are a felony, with fines of $500-$2,000 and up to 30 days' jail reported for related provisions. The ban takes effect November 1, 2026, at which point this vertical becomes prohibited.[12],[13],[14] | ||
| Prediction markets | Not authorized | CFTC-registered event-contract platforms such as Kalshi are available to Oklahoma residents statewide under claimed federal preemption; no Oklahoma regulator, attorney general, or court has taken action against them, unlike Arizona, Ohio, Massachusetts and Nevada, which have. Oklahoma sits in the 10th Circuit, which has not ruled on the CFTC-preemption question.[15]? | ||
| Skill games | Prohibited | Non-compact "eight-liner"/coin-pusher machines paying cash or cash-equivalent prizes are treated as illegal gaming devices by the Oklahoma Tax Commission outside the tribal/racetrack compact framework; a 2014-15 Cherokee County enforcement action (OTC compliance officer flag, sheriff's office investigation) targeted such machines at local businesses. Separately, a federal case found the Absentee Shawnee Tribe's claimed "skill" gaming machines were in fact Class II/III games of chance under IGRA, not exempt carnival/amusement games, and ordered them halted. Title 3A's compact-based "electronic amusement games" (which include a skill element per § 270) remain a distinct, compact-authorized category, not an unregulated grey-machine one.[4],[16] | ||
| Card rooms | Not authorized | Non-house-banked card games are authorized only as a tribal "covered game" under compact; there is no license category for standalone commercial card rooms.[1] | ||
| Lottery couriers | Not authorized | Oklahoma has no courier-specific authorization or ban, and no major courier such as Jackpocket currently serves the state, unlike the 16+ states Jackpocket lists as served.[17],[9] | ||
| Pick'em fantasy | Not authorized | Same gap as dfs; no statute found authorizing or banning pick'em-style fantasy contests, which operate as gray-market presence without enforcement.[11] | ||
| Pari-mutuel | Live | Competitive | Live pari-mutuel horse racing regulated by the Oklahoma Horse Racing Commission; racetracks include Remington Park and Will Rogers Downs. 3A O.S. Ch. 2 (Horse Racing) [4],[18] | |
| Advance deposit wagering | Not authorized | Oklahoma has no dedicated ADW operator-licensing statute yet, but Senate Bill 1955 (introduced January 2026) would direct the Oklahoma Horse Racing Commission to adopt rules licensing advance-deposit account wagering and would require providers accepting wagers from Oklahoma IP addresses to hold a Commission license; a similar 2022 bill (HB 3936) proposed the same licensing structure. Under the federal Interstate Horseracing Act, an interstate ADW operator may accept Oklahoma wagers only with consent from the host racing association, host racing commission, and Oklahoma's own racing commission as the "off-track racing commission" -- meaning some ADW activity already occurs via that federal consent mechanism even without a standalone state ADW statute.[19],[20]? | ||
| Charitable gaming | Live | The Oklahoma Charity Games Act (3A O.S. § 401 et seq.) lets qualifying charitable organizations run bingo and other specified games of chance; games of chance run by non-charitable ("commercial bingo") operators are prohibited. Implementing rules sit in Oklahoma Administrative Code Title 45 (ABLE Commission), Chapter 50. Licensure requires a minimum 2 years' continuous existence and a $100 annual registration fee; the per-session bingo prize cap is $6,000, and the minimum age is 18 (minors may play if accompanied by a parent or guardian). Oklahoma Charity Games Act, 3A O.S. §§ 401-428 [21]? | ||
| Esports betting | Not authorized | Not a covered game under the compact and no separate statute authorizes esports wagering.[1] | ||
| Social casino | Live | Competitive | No Oklahoma-specific statute, AG opinion, or enforcement action restricts free-to-play social casino apps with no cash-redeemable prize; such apps fall outside Oklahoma's gambling definition, which requires risking something of value on a game of chance for a thing of value. Oklahoma's new sweepstakes-casino ban (SB 1589, effective Nov. 1, 2026) instead targets dual-currency games that risk "representatives of value," not pure free-to-play social casino with no prize redemption.[12] |
