Nevada

More detail
  • Legal framework. Commercial casino gaming has been legal since 1931 and single-game sports wagering since 1949. That was decades before PASPA grandfathered the state in.
  • Taxes. Casinos, sports pools, and online poker (but not full online casino) are taxed under one tiered percentage fee on gross revenue (NRS 463.370).
  • Lottery. Nevada has no state lottery. It is the only state whose constitution bans one.
  • Prediction markets. In 2025-2026 the Gaming Control Board has been the lead litigant against Kalshi's unlicensed sports-event contracts. It won a Ninth Circuit ruling in August 2026 that Kalshi's sports contracts are not CFTC-exempt swaps.

Sports (online)Live2010CompetitiveAB 466 (2001, Ch. 593), approved by Gov. Kenny Guinn on June 14, 2001, created the Interactive Gaming Act; most sections, including the "interactive gaming" definition now at NRS 463.016425, took effect July 1, 2001. That definition expressly excludes a race book or sports pool's use of board-approved communications technology to accept wagers originating within Nevada, leaving sports-pool account/phone wagering regulated under the existing Regulation 22 framework rather than the new interactive-gaming licensing regime AB 466 created for other games. (No "AB 471" sports-wagering bill was found in the 2001 session; a 2005 AB 471 later authorized unrelated in-casino mobile gaming devices.) Mobile sportsbook apps (American Wagering/Leroy's, William Hill, now Caesars, others) have been available statewide since 2010, but new accounts must still be registered in person at a licensed sportsbook; remote-registration proposals have not been adopted as of 2026.

Online casinoNot authorizedInteractive gaming under Regulation 5A is limited to poker; blackjack, roulette, slots and other banked casino games were excluded when the regulation was adopted in 2011 due to land-based industry opposition. A 2021 proposal to remove the poker-only limit was shelved; 2026 Regulation 5A amendments addressed definitions and interactive systems but did not add banked casino games.[6],[7]
Online pokerLive2013CompetitiveAB 258 (2011) revised NRS 463.750 to direct the Gaming Commission to adopt interactive-gaming regulations; Gov. Brian Sandoval approved it on June 10, 2011 as Chapter 302 of the 2011 Statutes of Nevada, with the act effective the same day (signing date and effective date are the same per the bill's official history). The Commission adopted the resulting Regulation 5A on Dec. 22, 2011, limited to online poker. Ultimate Poker launched the first legal real-money online poker site in the U.S. in April 2013. Nevada entered the first interstate online-poker liquidity-sharing compact with Delaware in Feb. 2014 (live March 2015); New Jersey, Michigan and Pennsylvania later joined the Multi-State Internet Gaming Agreement (MSIGA).

Commercial casinosLive1931CompetitiveGovernor Fred Balzar signed Assembly Bill 98 on March 19, 1931, legalizing open-wheel/table gambling statewide; Nevada issues 'nonrestricted' licenses (16+ slots or any table games) and 'restricted' licenses (up to 15 slots, no other games) to bars, taverns, grocery and convenience stores.

Tribal casinosLimitedMonopoly TribalSeveral Nevada tribes (e.g., Pyramid Lake Paiute, Te-Moak Tribe of Western Shoshone, Walker River Paiute, Washoe Tribe) hold IGRA Class III compacts with the state, mostly slots-only facilities, smaller in scale than the state's commercial casino industry. Current full compact count is secondary-source only.

LotteryProhibitedNevada's 1864 Constitution copied California's lottery ban; it is the only state whose constitution specifically bars a state lottery, and remains one of five states with no lottery. Current text (as amended 1990) says "no lottery may be authorized by this State, nor may lottery tickets be sold," with a carve-out letting the Legislature authorize charitable/nonprofit raffles or drawings only, proceeds restricted to charitable/nonprofit use. A repeal resolution (AJR5) passed the Legislature in 2023 and needed a second passage before going to voters, expected as a 2026 ballot question.

iLotteryNot authorizedNo state lottery exists, so there is no iLottery product.[12]
Daily fantasyLimitedHybridIn October 2015 the Gaming Control Board found that daily fantasy sports constitutes a sports pool/wagering under Nevada law and requires a sports-pool license; DraftKings and FanDuel suspended Nevada operations rather than seek licensure. Only licensed sports-pool operators may legally offer DFS-style contests.

VGTs / VLTsLimitedCompetitiveNevada's "restricted gaming license" (up to 15 slot machines, no other games) at bars, taverns, grocery and convenience stores functions similarly to other states' VGT programs, but is licensed as ordinary slot-machine gaming under NRS 463, not a separate VGT category.
NRS 463.373; NRS 463.0189 (restricted license)
[15]
Historical horse racingNot authorizedNo Nevada statute or Gaming Control Board regulation authorizes historical horse racing (HHR) terminals. Nevada's broad commercial slot-machine licensing under NRS 463 makes an HHR workaround unnecessary, unlike HHR states that otherwise ban slots.[16]
Sweepstakes casinosContestedNevada has no statute naming dual-currency sweepstakes casinos specifically, but SB 256 (2025) raised penalties for unlicensed online gambling operators (civil disgorgement of profits; playing through an unlicensed operator upgraded from misdemeanor to gross misdemeanor with up to 1 year jail). Most national sweepstakes-casino operators (e.g., Ruby Sweeps, exiting Aug. 15, 2025) have voluntarily blocked Nevada.[17],[18]
Prediction marketsContestedNevada sits in the Ninth Circuit. Gaming Control Board sent Kalshi a cease-and-desist letter (March 2025); Kalshi sued and won a preliminary injunction (April 2025, Judge Andrew P. Gordon, D. Nev., docket 2:25-cv-00575-APG-BNW); Gordon dissolved the injunction (Nov. 2025); the Ninth Circuit affirmed in KalshiEX, LLC v. Assad, No. 25-7516 (9th Cir. Aug. 28, 2026), holding Kalshi's sports-event contracts are not CFTC-preempted swaps because the CEA's swap definition requires a nexus to a financial/economic/commercial consequence, not a sporting outcome -- so Nevada's gambling law is not preempted as to sports contracts -- and remanded the separate election-contracts preemption question to the district court. Board has since pursued a civil enforcement action in Carson City District Court; Kalshi could seek en banc or Supreme Court review, and the ruling directly conflicts with the Third Circuit's Kalshi-friendly New Jersey decision (2026-04-06), raising the odds of eventual Supreme Court review.[19],[20],[21]
Skill gamesNot authorizedNo Nevada statute or regulation carves out unlicensed "skill game"/grey-machine terminals from NRS 463's broad gaming-device licensing requirement. No Nevada-specific grey-machine legislation or enforcement action has been identified, consistent with Nevada regulating virtually all gaming devices as licensed slot machines under NRS 463.[16]

Pari-mutuelLimitedCompetitiveNevada Gaming Commission licenses pari-mutuel meetings (trotting, pacing, chariot, cutter racing); live racing has sharply declined and most wagering is via simulcast. Live horse-race pari-mutuel handle is taxed at 2% under NRS 466.125; state fair associations, agricultural societies, county fair/recreation boards, and nonprofit race organizations pay a reduced 1% rate. Separately, NRS 464.040 imposes an unrelated 3% tax on the total amount wagered on any race, sporting event, or other event for licensees under that chapter (off-track/other-event wagering operators), which is a distinct licensee category from on-track pari-mutuel racing under Chapter 466.

Advance deposit wageringLiveCompetitiveOff-track and advance-deposit pari-mutuel wagering on races/events is licensed and taxed separately from on-track wagering under NRS Chapter 464 (3% tax on amount wagered, NRS 464.040); this is a distinct license category from on-track NRS 466 pari-mutuel.

Charitable gamingLiveCharitable bingo/raffles are tiered by quarterly prize value: notification only if total prizes 2,500 dollars or less; registration (10 dollar fee) if 2,500-50,000 dollars; Gaming Control Board approval (25 dollar fee) if prizes exceed 50,000 dollars.

Esports bettingLiveCompetitiveRegulation 22, section 22.1202 lets a sports pool accept wagers on esports events once it gathers and documents detailed information about the video game, the event operator, the event's integrity safeguards, and the technology used to determine outcomes, or once the event operator is already on the Gaming Control Board's list of approved sanctioning organizations.[26]
Social casinoLiveFree-to-play, no-prize-redemption social casino apps fall outside NRS 463's gambling/gaming-device definitions (no thing of value is risked or won) and are not treated as licensed gambling by the Gaming Control Board; applying this database's national convention for pure social casino.[16]

Notes

Free-text notes that fit no other field
Nevada's gaming tax structure (NRS 463.370) is unusual among states in taxing essentially all forms of nonrestricted gaming revenue — table games, slots, and sports wagering — under one tiered percentage-fee schedule, rather than separate statutory tax rates per vertical as in newer PASPA-era states.[15],[16]

Sports betting rules

Wagering on college sports allowed at all
Yes[5]
Wagering on in-state college teams allowed
Yes
Reversed a decades-old (1950s) ban in 2001; Nevada allows betting on UNLV and UNR games, with a $3,000 reporting threshold for unusual wagers, unlike many newer states that still exclude in-state teams.
[5]
Individual college player prop bets allowed
Yes
Regulation 22's list of prohibited wagers bars bets on non-collegiate/non-Olympic amateur events, election outcomes, and wagers placed by or for an event's officials, owners, coaches, staff, or participants, but does not single out college player-performance props for exclusion.
[26]?
Credit cards may be used to fund accounts
Yes
Regulation 5, section 5.225(9)(d) lists debits from a patron's debit instrument, prepaid access instrument, or credit card among the permitted ways to fund a wagering account; Regulation 22 applies this same section to sports-pool accounts without modification.
[27],[26]
Esports wagering allowed
Yes
Allowed under Regulation 22, section 22.1202, once a book documents detailed information about the video game, event operator, integrity safeguards and outcome-determination technology, or the event operator is already on the Board's approved sanctioning-organization list.
[26]
New online accounts must be created in person
Yes
Regulation 22, section 22.140(6)(a)(1) requires a patron opening a sports-pool wagering account to personally appear before a book employee to present identification, rather than using the remote identity-verification method that Regulation 5 otherwise allows for wagering accounts generally. Sightline Interactive separately petitioned the Commission to amend this requirement for digital identity verification, and a Gaming Control Board workshop on remote verification was canceled and has not been rescheduled. Nevada remains the only major sports-betting state without remote registration.
[2],[26],[27]
Online sports wagering available statewide (not tethered to premises)
Yes[2]
Operators must use official league data for some bets
No
A sports pool may only accept wagers on a contingency other than a game's final outcome if the result can be confirmed through reputable national or international media reporting, or through official records kept by the relevant league, governing body, or its designated statistics provider; media reporting is an accepted alternative, not an exclusive official-data mandate.
[26]
Summary of prop-bet restrictions (e.g. no in-game player props)
No prop-specific restriction beyond the general rules that a wager's outcome must be independently confirmable (via media reporting or official league/governing-body records) and that no wager may be accepted from, or on behalf of, an event's officials, owners, coaches, staff, or participants.[26]

Sweepstakes

Statute or regulator action specifically bans dual-currency online sweepstakes casinos
No
SB 256 (2025) increased penalties on unlicensed online gambling generally rather than naming sweepstakes casinos explicitly; most operators have exited the state voluntarily.

Casino gaming is taxed through three separate mechanisms with different destinations. The NRS 463.370 percentage fee on gross gaming revenue (the largest component) goes to the State General Fund. The NRS 463.385 annual per-slot-machine excise tax goes mostly to the State Education Fund, with the remainder to two higher-education capital-construction funds. The NRS 463.380 license fee graduated by table count goes to county (not state) general funds.

What these figures mean
  • Commercial casinos: GGR is the "Total Gaming" win line for all nonrestricted locations statewide. Tax paid is NGCB's own printed statewide percentage-fee dollar figure from its separate "Monthly Win and Percentage Fee Tax Collections" press release, keyed to the business month it names. Excludes restricted locations such as bars and taverns. tax_paid covers ALL nonrestricted gaming combined (table games, slots, and the sports pool); NGCB never splits it by vertical.
  • Sports (retail): GGR is the "Sports Pool" win line, which combines retail and mobile sports wagering. Mobile is not split out, so this series is all sports wagering despite the retail name. tax_paid is permanently blank -- NGCB's tax-collections report has no isolatable sports-pool-only figure (see casino_commercial's tax_label).

Subsection 2(a) sends that revenue (the bulk of it being the NRS 463.370 percentage fee, which covers table games, slots and sports wagering alike) to the State General Fund. Subsections 2(c)-(d) carve out a small share of the NRS 464.045 off-track pari-mutuel licensees' contribution to the 463.370 fee for horse-race purses in smaller host counties; that carve-out is specific to off-track pari-mutuel wagering, not sports wagering or casino games generally.
